These Terms of Service (“Terms”) govern your use of the Textacy mobile app, the website at textacy.com and related services (the “Service”), provided by Telecom CJV LLC (“Textacy,” “we,” “us”).
Accepting these terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be old enough to form a binding contract where you live, and if you use the Service on behalf of a business, you agree to these Terms on its behalf.
Your account
You agree to give accurate information when you register and to keep it up to date. You are responsible for keeping your login details secure and for all activity on your account. Tell us right away at [email protected] if you think your account has been used without your permission.
Your Textacy number
We assign you a phone number for use with the Service. Phone numbers are regulated telecommunications resources: you do not own the number, and we may need to change or recover it if required by law, by a carrier or regulator, or if your account is closed or violates these Terms.
Acceptable use
You may use the Service only for lawful, personal or business communication. You agree not to:
- Send spam, unsolicited bulk or marketing messages, or automated or prerecorded calls without the consent the law requires.
- Harass, threaten, stalk, defraud or impersonate anyone, or misrepresent who you are.
- Send content that is illegal, sexually exploits minors, infringes others’ rights or promotes violence.
- Spoof caller ID, or use the Service to evade blocking by another person.
- Interfere with, overload, reverse engineer or try to gain unauthorized access to the Service.
- Resell the Service or use it in a way that violates carrier rules or applicable telecommunications laws.
We may investigate and take action on suspected violations, including removing content, suspending your number and cooperating with law enforcement.
Emergency calls
Textacy is not a replacement for your mobile phone service and should not be relied on for emergency calls. Calls in Textacy depend on an internet connection and may not reach emergency services or provide your location. In an emergency, always dial 911 from your phone’s built-in dialer.
Fees
Textacy is free to download. If we offer paid features, the price and terms will be shown in the app before you buy, and purchases are processed by Apple or Google under their payment terms. Your mobile carrier or internet provider may charge for the data the app uses.
App stores
If you downloaded Textacy from the Apple App Store or Google Play, you also agree to that store’s terms. Apple and Google are not responsible for the Service or for supporting it, and have no obligations to you under these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms for iOS users and may enforce them.
Suspension & termination
You may stop using the Service and ask us to close your account at any time. We may suspend or end your access, with or without notice, if you violate these Terms, if required by law or a carrier, or if we stop offering the Service. Sections that by their nature should survive termination will survive.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that calls or messages will always be delivered, delivered on time, or that the Service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent allowed by law, Textacy and Telecom CJV LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or messages, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $50.
Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Douglas County, Colorado, and you consent to their jurisdiction.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. If you keep using the Service after changes take effect, you accept the updated Terms.
